In a significant legal development, Uniqlo, a subsidiary of Fast Retailing Co., has filed a lawsuit against Shein in Japan, alleging the unauthorized replication of its highly sought-after Round Mini Shoulder bag. Fast Retailing, Uniqlo’s parent company, issued a statement on Tuesday demanding an immediate halt to the sales of what it deems «imitation products» by Shein and seeking compensation for damages.
The Round Mini Shoulder bag, priced at approximately ¥1,500 ($10) in Japan, has garnered widespread global acclaim. Uniqlo has actively cautioned consumers about the presence of potential counterfeits and similar products circulating online. This legal action follows a trend, with Fast Retailing joining rival Hennes & Mauritz AB in pursuing copyright infringement claims against Shein in Hong Kong since 2021, aiming to address the competitive threat posed by the Chinese retailer.
Despite Shein being founded in China and currently headquartered in Singapore, the company has not yet responded to requests for comments regarding the lawsuit. Uniqlo initiated legal proceedings against Roadget Business Pte, Fashion Choice Pte., and Shein Japan Co. on December 28 at the Tokyo District Court.
Fast Retailing clarified its decision to file the lawsuit, stating, «The company filed this complaint because it has determined that the form of the imitation products sold by Shein closely resembles that of its own product. The sale of the imitation products by Shein significantly undermines the high level of customer confidence in the quality of the Uniqlo brand and its products.»
As this legal battle unfolds, it sheds light on the persistent challenges of intellectual property infringement within the fashion industry and the proactive measures taken by brands to safeguard their unique designs while upholding customer trust.
